In the absence of concrete legal requirements, the question of how to properly design a consent banner keeps coming up. Various guidelines and the German Orientation Guide for Telemedia Providers offer support, but what does this really mean in practice? As a member of the Cookie Banner Taskforce of the European Data Protection Board, the Bavarian Data Protection Authority has taken a close look at these issues. Carolyn Loy highlights the five most common mistakes and demonstrates in practical terms how to design legally compliant banners for websites and apps.

Carolin Loy originally trained as a lawyer. After completing her second state exam, she worked in civil law and later in insolvency law as a fully qualified lawyer. Since April 2020, she has been part of the Bavarian Data Protection Authority, where she serves as deputy head of the department for Internet, telemedia and apps. Since September 2022, she has also headed the unit for European cooperation.
